Competition Commission settles with Foskor

Johannesburg-The South African Competition Commission has entered into a consent agreement with Foskor in the settlement of a phosphoric acid pricing complaint. The complaint arose in 2007 with allegations that Foskor had entered into a tolling agreement with Sasol, and the Commission found this constituted a division of markets between the two. In addition, Foskor was charged with excessive pricing. The Commission said that as soon as Foskor was made aware of the anti-competitive implications, it substantially reduced prices to local customers and has kept local and export prices in line. Due to this quick action, the Commission did not seek a penalty against Foskor. Sasol admitted to the arrangement earlier and settled in 2009.
